ORA’S TERMS AND CONDITIONS OF PURCHASE
Please read the terms and conditions carefully before using www.oraspring.com (the “website”). By using and shopping on our website, you agree to accept the terms and conditions described below. As the terms and conditions may be updated from time to time we recommend that you check this page regularly to take notice of any changes we may have made in the terms and conditions.
1- GENERAL INFORMATION
These Terms and Conditions apply to any online sales carried out on the website www.oraspring.com (hereinafter referred to as the Website) owned by SHISERON INVESTMENT, S.L. (hereinafter referred to as ORA SPRING).
Shiseron Investment S.L. is a limited company with registered address at c/ Calvet 67-69, of Barcelona (08021) holder of Tax Identification Number [NIF] B66533613, and registered in the Commercial Register in folio 212, Volume 37.507, Sheet B-301591, 1rst inscription.

Shiseron Investment S.L. owns the brand “ORA SPRING”.
In all events, use by the customer of the services offered on the Website represents acceptance of the Terms and Conditions of Purchase, based on the version published by ORA SPRING at the time of the purchase order.
ORA SPRING’s purpose is wholesale and retail of jewelry, silverware and costume jewelry either online or by other means.
2- INTELLECTUAL AND INDUSTRIAL PROPERTY
All contents (including the graphic design, source code, logos, texts, graphics, illustrations, photographs, trade names, trademarks or distinguishing signs and any other elements appearing on the Portal), unless specifically stated otherwise, are owned exclusively by ORA SPRING or third parties.
No intellectual or industrial property rights with regards to the Portal or any of its integral elements shall be assigned to the customer, and the reproduction, transformation, distribution, public communication, provision, extraction, reuse, reshipment or use of any nature, by any means or procedure, of any of them is expressly prohibited, except in the cases permitted by law or when authorized by the holder of the corresponding rights.
The customer may view and obtain a private temporary copy of the contents for exclusive personal, private and non-collective use on his/her computer systems (software and hardware), provided that such use is not carried out with the purpose of developing collective, commercial or professional activities. The customer must abstain from obtaining or attempting to obtain the contents by means or procedures other than those which have been made available to him/her or indicated for that purpose or those used frequently on the Internet (provided that they do not pose a risk of damage or a risk of rendering the Portal useless). The customer must respect the intellectual and industrial property rights of the Portal at all times, which are held by ORA SPRING or third parties.
In any event, ORA SPRING reserves the right to modify, at any time and without prior notice, the presentation and configuration of the Portal, as well as the General Conditions or the corresponding Specific Conditions.
3- PRODUCT AVAILABILITY
The availability of products on the website is updated based on our stock. All product orders are subject to the availability of the products.
ORA SPRING will not intentionally put more units on sale than are available in stock.
If due to reasons it cannot control or by mistake ORA SPRING puts on sale a product not available in stock and it is purchased by a customer, ORA SPRING agrees to act in good faith and offer the same customer the choice of:
- A refund of any amounts they have paid without penalty and using the same means by which payment was made.
- Replacement by another model of the same quality and value available in stock with the customer’s consent.
- If there is a chance the product may become available, send it with a new delivery time.
4- AVAILABILITY OF THE ONLINE PURCHASING SERVICE
The Service will be permanently available 24 hours/day. ORA SPRING informs the customer that anomalies or interruptions in the availability or functioning of the Service due to reasons not attributable to ORA SPRING (technical problems with Internet providers, telecommunications, problems with the customer’s terminal, etc.) may produce delays and the purchasing of products or services may take longer.
The prices of products shown on www.oraspring.com include VAT (at the rate applicable by law at any given time) unless otherwise stated.
Prices do not include shipping charges unless otherwise stated.
ORA SPRING accept no liability for any errors in the prices of the items shown. If there is an error in the final price of any item shown, ORA SPRING will tell customers the new sale price as soon as possible and give customers concerned the chance to reconfirm their order or cancel their purchase
If we cannot contact the customer their order will be cancelled and they will be given a refund of the amount of the wrong price they have paid. ORA SPRING is not obliged to supply customers with a product at a wrong lower price even if their order has been confirmed
Prices of items shown on the website are subject to variation. However, except as set out above for cases of error, any changes will not affect orders for which we have already sent an Order Confirmation email.
6- ELIGIBILITY FOR MAKING PURCHASES
You represent and warrant you will act in good faith by using this website only to make legitimate enquiries or orders and not to acquire products on www.oraspring.com for the purpose of resale or parallel distribution that brings you commercial gain.
If we think that a false or fraudulent order has been placed, we reserve the right to cancel it and reimburse the customer for any payments they have made without penalty for ORA SPRING.
By using this website you undertake to truthfully and accurately provide the information you are asked for and agree that ORA can use this information to contact you if need be. If you do not give us full information you will not be able to place your order.
By placing an order on the website you represent that you are over 18 and are legally allowed to enter into contracts.
7- PAYMENT METHODS
ORA SPRING provides its customers with a secure online payment gateway for credit and debit cards (Visa, MasterCard,) operated by Paypal.
By authorizing payment you confirm that you are the holder of the credit card or debit card. Credit cards are subject to validation checks and authorization by their issuer, so if the issuer does not authorize the payment, ORA SPRING will not be liable for non-delivery or late delivery as the purchase has not been completed.
ORA SPRING will never store sensitive information such as card numbers or authentication codes.
We can also accept payment by bank transfer or deposit under special conditions. In this case ORA SPRING reserves the right to delay sending the purchase until it has the necessary payment guarantees.
Clients agree to make full payment for the products purchased in the time specified by ORA SPRING.
7.1 Completing the order
Once you have accepted the terms and conditions of use and confirmed your purchase, you will receive an Order Confirmation email with the details of the transaction.
8- DELIVERY AND RETURNS POLICY
Shipments are made using a courier service chosen by ORA SPPRING and delivery times depend on the availability of products making up the shipment.
8.1 Delivery times and method
ORASPRING’s jewel is handmade. Once the purchase is confirmed, delivery time will be indicated.
If your order is delayed you can cancel it and we will refund what you have paid but you will not be entitled to any compensation.
If within five working days from the Order Confirmation you have not agreed a delivery date with the carrier, you will have to contact us. If you do not contact us, the carrier will return your order to us and you will have to pay handling costs for shipping and return.
8.2 Geographical limits
There is an European geographical restriction on delivery of jewelry items.
If costumers out of the European area is interested in ORA SPRING jewel, he might contact ORA at www.oraspring.com for special delivery and informations.
8.3 Delivery check
You agree to check the condition of your shipment when it is delivered by the carrier. If there is a problem (broken security tags, external blows, moisture, etc.) you should state what it is on the delivery note and may refuse to accept the delivery.

Delivery will be completed when you (or someone else on your behalf) takes material possession of the product as demonstrated by signing the order receipt note at the delivery address.
8.4 Right of cancellation
As a consumer and user you may return your order within 14 calendar days from its delivery.
If you want to return an item, you must contact us and follow the instructions we give you. We will not accept returns that do not use the procedure and means we have specified.
You may not cancel special or personalized orders.
We do not refund delivery and return charges.
We do not accept returns of products that have been handled or used or whose security seals have been removed.
You must return items in their original packaging (box, documentation, accessories, etc.).
You cannot return custom-made and/or personalized products.
Once we have checked that the returned products meet authenticity and condition requirements, we will give you a refund within 15 working days using the same method in which you made your purchase.
8.5 Customs declaration and international taxes and fees
All international shipments and shipments to the Canary Islands, Ceuta and Melilla will be accompanied by an import/export declaration for the customs authorities. This document shows the total amount of the order.
You will have to pay any international fees or taxes levied on the products in the place where they are collected.
Under Spain’s Warranties in the Sale of Consumer Goods Act 23/2003, of 10 July, the manufacturer or brand of the product purchased is responsible to the customer for any lack of conformity due to manufacturing defects existing at the time of delivery and which become apparent during the following two years.
You have two months in which to report any incident caused by manufacturing defects from when you become aware of it.
If the manufacturer brand of the product purchased checks and confirms the existence of a manufacturing defect, it will repair or replace the item. This will be at your choice, where technically possible and as long as you have reported the incident within the deadline.
Cases which will not be accepted as manufacturing defects:
- General damage caused by misuse or abnormal use of the product.
- Knocks and scratches caused by normal use of the product.
- Detachment or breakage of gems or other components applied.
- Spots or changes in sheen of metals, gems or other components caused by external chemical agents.
- Specific cases for watches which are excluded from the warranty:
- Battery life.
- Wear and tear.
- Damage caused by misuse of the product or lack of maintenance.
- Any warranty is void if personnel who are not authorized for this purpose by the manufacturer manipulate the product.
Any other claims against the manufacturer are excluded except for your statutory rights.
10- CUSTOMER SERVICES
Those purchasing ORA SPRING products may submit complaints and claims to the following address: www.oraspring.com or ORA SPRING C/ Calvet 67-69, 1º1º, Barcelona (08021).
ORA SPRING shall not cover the cost of deliveries to the after-sales department.
11- PREVENTION OF MONEY LAUNDERING AND TERRORIST FINANCING
Under Section 4 of Spain’s Prevention of Money Laundering and Terrorist Financing Act 10/2010, of 28 April, you represent and warrant that you are the beneficial owner of the transaction, and we hereby advise you that your personal information may be given to the public authorities, which are legally entitled to view it.
If the purchase amount exceeds €1,000 you will be required to identify yourself with a copy of your valid ID card or passport.
ORA reserves the right to withhold the order until you identify yourself.
12- LAW AND JURISDICTION
Any conflicts arising from these terms of purchase shall fall under the competence of the Spanish courts. Spanish law shall also apply (Consolidated Text of the General Consumer and User Protection Act) for any aspects that are not foreseen in these terms.
ORA SPRING does not belong to any association or organization that offers an extrajudicial dispute resolution system.
